Privacy Policy

This Privacy Policy explains how Rxely ("Rxely," "we," "us") collects, uses, shares, and protects personal information when you visit rxely.com or try.rxely.com, complete a health assessment, buy a plan, or contact us. It also explains the choices you have.

Health information is sensitive

Much of what you share with Rxely is health information: your weight, conditions, medications, and goals. We treat every answer in your assessment as health information, whether or not a specific law labels it that way. We limit access to the people and companies that need it to provide your care, fill your prescription, support your account, or meet legal duties.

We do not sell your health information. We do not share the answers in your health assessment with advertising companies.

Information we collect

• Your health assessment. Name, date of birth, sex, height, weight, state of residence, medical history, current and past conditions, current medications and supplements, allergies, pregnancy or breastfeeding status, past weight care, and goals. It also includes any photos, lab results, or documents you upload or a clinician asks for.
• Account and contact details. Email address, phone number, shipping address, and login details.
• Identity checks. If a clinician or the pharmacies need to confirm who you are, we may ask for a photo ID or similar information.
• Payment information. Card details are collected and processed by our payment processor. We may receive limited details such as the card brand, the last four digits, and your billing ZIP code, along with your order history.
• Care and support records. Messages with Rxely support and your care team, check-in answers, prescription and shipping status, and records of the consents you give.
• Device and usage information. When you use our websites, we and our service providers collect your IP address, browser and device type, pages visited, referring links, and visit times, using cookies, pixels, and similar tools.

How we use information

• To create your account and run your health assessment.
• To send your assessment to a licensed clinician through LocumTele for review and follow-up care.
• To send prescriptions to Believe Rx (sterile) or Rush Pharmacy in Oviedo, Florida (non-sterile) so they can fill and ship them.
• To process payments and plan renewals.
• To contact you about your assessment, care, orders, account, and support requests.
• To verify identity, prevent fraud and misuse, and keep the Services safe.
• To meet legal, regulatory, and pharmacy recordkeeping duties.
• To improve our websites and services, using de-identified or combined information where we can.
• To send marketing messages where the law allows, and only with your consent where the law requires it. You can opt out at any time.

How we share information

We share personal information only in these ways:

• With clinicians. Licensed clinicians through LocumTele receive your assessment and related information to evaluate you, make treatment decisions, and provide follow-up care.
• With the pharmacies. If you are prescribed medication, Believe Rx (sterile fulfillment) or Rush Pharmacy in Oviedo, Florida (non-sterile fulfillment) receives your prescription, contact details, shipping address, and the health information it needs to fill and ship it safely.
• With service providers. Companies that host our systems, process payments, ship orders, send emails and texts, run support tools, or measure website performance. They work under contracts that limit how they can use the information.
• For legal reasons. When a law, subpoena, or court order requires it; to respond to government or regulatory requests; to protect the rights, safety, or property of patients, Rxely, or others; or to enforce our Terms of Use.
• In a business transfer. If Rxely is part of a merger, acquisition, financing, or sale of assets, personal information may transfer as part of that deal. This policy continues to apply to it.
• With your consent. For any other purpose you agree to.

Clinicians, the pharmacies, and HIPAA

LocumTele clinicians, Believe Rx, and Rush Pharmacy are health care providers. The medical and pharmacy records they create and keep about you are protected health information under the federal Health Insurance Portability and Accountability Act (HIPAA) and state medical privacy laws, and each provider handles those records under its own notice of privacy practices. Information you give Rxely outside that care relationship, such as how you browse our websites, is covered by this Privacy Policy.

Cookies, pixels, and analytics

Our websites use cookies and similar tools to keep the site working, remember your preferences, measure traffic, and understand how visitors find us. Some of these tools come from analytics and advertising companies. We do not send the answers in your health assessment to advertising companies.

You can block or delete cookies in your browser settings. Blocking some cookies may stop parts of the site from working. Where state law requires it, we honor Global Privacy Control signals as a request to opt out of targeted advertising for that browser.

Texts, calls, and email

If you give us your phone number, you agree that Rxely, your clinicians, and the pharmacies may call or text you about your assessment, prescriptions, shipments, account, and care. Message and data rates may apply. We send marketing texts only with your consent, and consent is not a condition of purchase. Reply STOP to any text to stop further texts, or HELP for help. Every marketing email has an unsubscribe link. We may still send messages you need about your care and orders.

How long we keep information

We keep personal information for as long as we need it to provide the Services, meet legal and pharmacy recordkeeping requirements, resolve disputes, and enforce our agreements. Clinicians and the pharmacies keep medical and pharmacy records for the periods state and federal law require. That can be several years after your last visit, even if you close your account.

How we protect information

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit and access limited to the people who need it. No system is perfectly secure, and we cannot guarantee the security of information sent over the internet. If a breach affects your information, we will notify you as the law requires.

Your rights and choices

Depending on the state where you live, you may have the right to:

• Know what personal information we have about you and get a copy of it.
• Correct information that is wrong.
• Delete personal information, subject to legal exceptions such as medical recordkeeping.
• Opt out of targeted advertising, the sale of personal information, and certain profiling.
• Withdraw consent you gave for us to collect or share consumer health data.

To make a request, email [email protected] from the address on your account. We will verify your identity before we act. Where the law allows, you can use an authorized agent. If we deny your request, you can appeal by replying to our decision. We will not treat you differently for using these rights. Requests about medical or pharmacy records may be handled by LocumTele, Believe Rx, or Rush Pharmacy, and we will help route them.

Some states, including Washington and Nevada, have laws that protect consumer health data. Where those laws apply, we collect and share consumer health data only with your consent or as needed to provide the service you asked for. You can withdraw that consent or ask us to delete the data by emailing [email protected].

Adults only

Rxely is for adults 18 and older. We do not knowingly collect personal information from anyone under 18. If we learn that we have, we will delete it unless the law requires us to keep it.

United States only

Rxely operates in the United States. If you visit from outside the United States, your information is processed in the United States.

Changes to this policy

We may update this Privacy Policy. The date at the top of this page shows the latest version. If we make material changes, we will tell you by email or with a notice on our website before they take effect, where the law requires it.

Terms of Use

These Terms of Use ("Terms") are an agreement between you and Rxely. They apply when you use rxely.com, try.rxely.com, or other Rxely websites, complete a health assessment, or buy a plan (together, the "Services"). By using the Services, you agree to these Terms and to the Privacy Policy above. If you do not agree, do not use the Services.

What Rxely does

Rxely runs the websites, health assessment, checkout, and customer support for an online medical weight care program. Rxely does not practice medicine and does not dispense medication.

Medical care is provided by licensed clinicians through LocumTele. Sterile prescriptions are filled by Believe Rx. Non-sterile prescriptions are filled by Rush Pharmacy in Oviedo, Florida. Your clinician makes every medical decision using their own professional judgment. Rxely does not direct or override those decisions.

Eligibility

To use the Services, you must:

• Be at least 18 years old.
• Give true, accurate, and complete information, and keep it up to date.
• Use the Services only for yourself. Do not complete an assessment or create an account for anyone else.

Telehealth care

Care through Rxely is delivered by telehealth. Your clinician evaluates you using the information you submit online and, when needed, by message, phone, or video. Telehealth has limits: your clinician cannot perform a physical exam, and the evaluation depends on the accuracy and completeness of what you share. By starting an assessment, you consent to receive care by telehealth.

After reviewing your case, your clinician may prescribe a treatment plan, ask for more information or lab work, recommend a different approach or an in-person visit, or decline to prescribe. Completing an assessment or paying does not guarantee a prescription. Your clinician may also change or stop treatment at any time if it is no longer safe or appropriate for you.

Rxely is not for emergencies. If you think you have a medical emergency, call 911 or go to the nearest emergency room.

The Services do not replace your primary care provider. Keep seeing your regular doctor, and tell them about any medication prescribed to you through Rxely.

Prescriptions, compounded medication, and the pharmacies

Medications offered through Rxely are prescription only. Compounded semaglutide and compounded tirzepatide are prepared by a licensed pharmacy for an individual patient under a valid prescription. Compounded medications are not FDA-approved. FDA does not review them for safety, effectiveness, or quality before they are dispensed, and they are not the same as, or equivalent to, any brand-name medication.

If you are prescribed medication, your prescription goes to Believe Rx for sterile fulfillment or to Rush Pharmacy in Oviedo, Florida for non-sterile fulfillment, which fills it and ships it to the address you give. You agree to:

• Use the medication only as prescribed and as your written instructions describe.
• Store it as instructed, including refrigeration where required.
• Never share, sell, or give your medication to anyone else.
• Tell your clinician right away about side effects, new conditions, new medications, pregnancy, or planned surgery.

Pharmacy rules generally do not allow dispensed medication to be returned or resold. If a shipment arrives damaged, late, or at the wrong temperature, email [email protected] right away so we can review it with the pharmacies.

Prices, payments, and renewals

Prices are shown before you pay. You choose semaglutide or tirzepatide. Semaglutide is from $79 per month when prescribed. Tirzepatide is from $89 per month when prescribed. A licensed clinician decides whether prescribing is appropriate and may decline. Any assessment cost, plan length, what is included, renewal terms, and the refund terms for your purchase are shown at checkout.

By completing checkout, you authorize Rxely and its payment processor to charge your payment method for the amounts shown. If your plan renews automatically, you authorize recurring charges at the interval and amount shown at checkout until you cancel. You can cancel future renewals by emailing [email protected] before your next billing date. Cancelling stops future charges. Charges for medication already prescribed or shipped are refunded only if the checkout terms say so.

We may change prices for future purchases and renewals. If the price of an automatically renewing plan changes, we will tell you before the new price applies.

Your account

Keep your login details private. Tell us right away at [email protected] if you think someone else has used your account. You are responsible for activity under your account.

Acceptable use

You agree not to give false information or pretend to be someone else, use the Services to get medication for another person, interfere with or try to gain unauthorized access to the Services, scrape or copy the Services, or use them in any way that breaks the law.

We may suspend or end your access if you break these Terms, or when needed for safety or legal reasons. Clinicians and the pharmacies may also decline to treat you or fill a prescription for safety or legal reasons.

Content and ownership

The Rxely name, logo, website text, images, and design belong to Rxely or its licensors and are protected by law. You may view and print pages for your own personal use. Any other use needs our written permission. Content on the Services is general information and is not medical advice. See the Medical Disclaimer below.

Other websites

The Services may link to websites run by others. Those links are for convenience. Rxely does not control those websites and is not responsible for their content or practices.

Disclaimer of warranties

The Services are provided "as is" and "as available." To the fullest extent the law allows, Rxely disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Rxely does not guarantee any medical outcome, any amount of weight loss, or that a clinician will prescribe any medication, and does not promise that the websites will be uninterrupted or error-free.

Limitation of liability

To the fullest extent the law allows, Rxely and its officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of the Services. Rxely's total liability for any claim related to the Services is limited to the amount you paid Rxely in the 12 months before the claim arose.

These limits do not apply to liability that the law does not allow to be limited. They do not limit the professional responsibility of any clinician or pharmacy for the care they provide.

Indemnity

To the extent the law allows, you agree to cover Rxely's losses and reasonable legal costs from claims caused by your breaking these Terms or giving false information.

Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute related to these Terms or the Services will be brought in the state or federal courts located in Pinellas County, Florida, and you and Rxely agree to the jurisdiction of those courts. Before filing a claim, you agree to email [email protected] with a description of the issue and give us 30 days to try to resolve it informally.

Changes and general terms

We may update these Terms. The date at the top of this page shows the latest version. If we make material changes, we will give notice by email or on our website before they take effect, where the law requires it. Continuing to use the Services after an update means you accept the updated Terms. You can stop using the Services at any time.

If any part of these Terms is found unenforceable, the rest stays in effect. These Terms, the Privacy Policy, and any terms shown at checkout are the entire agreement between you and Rxely about the Services. If we do not enforce a term right away, we have not given up the right to enforce it later.

Medical Disclaimer and Important Safety Information

Read this before you start an assessment. If you are prescribed medication, also read the written information from your clinician and the pharmacy that fills your prescription (Believe Rx or Rush Pharmacy), and ask your clinician about anything you do not understand.

General information, not medical advice

Content on Rxely websites, including this page, FAQs, articles, and emails, is general information. It is not medical advice, diagnosis, or treatment, and reading it does not create a clinician-patient relationship. That relationship begins only when a licensed clinician through LocumTele reviews your assessment and agrees to treat you. Do not delay or ignore advice from your own doctor because of something you read on an Rxely website.

Telehealth services

Telehealth services are provided by licensed clinicians through LocumTele. Your clinician must be licensed in the state where you are located. Telehealth has limits, and your clinician may ask for lab work, more information, or an in-person visit before making a decision.

About compounded medication

Compounded semaglutide and compounded tirzepatide are prepared by a licensed pharmacy for an individual patient based on a prescription. They are not FDA-approved. FDA does not verify their safety, effectiveness, or quality before they are dispensed. They are not the same as, or equivalent to, any brand-name medication, and they are not generic versions of one. Their strength, form, and inactive ingredients can differ from FDA-approved products. Rxely makes no claim that compounded medication works the same as, or is as safe as, any FDA-approved medication.

Clinician judgment and results

These medications are available by prescription only. A licensed clinician decides whether any medication is appropriate for you and may decline to prescribe. Results vary from person to person and depend on your health, your plan, and other factors. Rxely does not guarantee weight loss or any specific result. GLP-1 medications are studied as an addition to a reduced-calorie diet and more physical activity, and your clinician may talk with you about both.

Important Safety Information

This summary covers known risks of semaglutide and tirzepatide. It does not list every risk. Ask your clinician and pharmacist for complete information.

Do not use these medications if you:

• Have a personal or family history of MTC, or have MEN 2.
• Have had a serious allergic reaction to semaglutide, tirzepatide, or any ingredient in the medication.
• Are pregnant or planning to become pregnant.
• Already use another semaglutide, tirzepatide, or GLP-1 receptor agonist product.

These medications are not for people with type 1 diabetes. Tell your clinician if you are breastfeeding.

Serious side effects can include:

• Inflammation of the pancreas (pancreatitis). Severe pain in your stomach area that will not go away, with or without vomiting. The pain may spread to your back. Stop the medication and get medical help right away.
• Gallbladder problems. Pain in your upper stomach, fever, yellowing of your skin or eyes, or clay-colored stools.
• Low blood sugar. The risk is higher if you also take insulin or a sulfonylurea. Signs include dizziness, shakiness, sweating, confusion, hunger, and a fast heartbeat.
• Kidney problems. Vomiting and diarrhea can cause dehydration, which can make kidney problems worse. Drink enough fluids.
• Severe stomach problems. Tell your clinician about stomach problems that are severe or will not go away.
• Serious allergic reactions. Swelling of your face, lips, tongue, or throat, trouble breathing or swallowing, severe rash or itching, fainting, or a very fast heartbeat. Get emergency help.
• Changes in vision in people with type 2 diabetes.
• Increased heart rate. Tell your clinician if your heart races or pounds at rest.
• Depression or thoughts of suicide. Watch for new or worsening mood changes and get help right away.
• Food or liquid getting into your lungs during surgery or a procedure that uses anesthesia or deep sedation. Tell every provider that you use this medication before any procedure.

Common side effects include nausea, diarrhea, vomiting, constipation, stomach pain, indigestion, heartburn, burping, bloating, headache, tiredness, dizziness, and injection site reactions. They are often stronger when you start or increase your dose.

Pregnancy and birth control. Tell your clinician right away if you become pregnant or plan to. Semaglutide should be stopped at least 2 months before a planned pregnancy. Tirzepatide can make birth control pills and other oral hormonal contraceptives less effective. If you use them, your clinician may advise adding a barrier method or switching to a non-oral method for 4 weeks after you start tirzepatide and for 4 weeks after each dose increase.

Other medications. These medications slow how fast your stomach empties and can change how your body absorbs medicines you take by mouth. Tell your clinician about every prescription, over-the-counter medicine, vitamin, and supplement you take.

Measuring your dose. Compounded injections may come in a different concentration from other products you have used. Measure every dose exactly as your written instructions say, with the syringe provided. FDA has received reports of overdoses from dosing errors with compounded semaglutide, often from confusion between milligrams, milliliters, and syringe units. If you are unsure about a dose, contact your clinician or the pharmacy before you inject.

Side effects and emergencies

Contact your clinician about any side effect that bothers you or does not go away. You can also report side effects to FDA at www.fda.gov/medwatch or 1-800-FDA-1088.

If you have a medical emergency or a severe allergic reaction, call 911. If you are in a mental health crisis or thinking about harming yourself, call or text 988 to reach the 988 Suicide and Crisis Lifeline.
